Terms of Use

These terms apply to the Mochi Pack app and its related services, published by BUBIAPPS Bilgi Teknolojileri Arge Ltd. Şti., Eğribucak Mah. Alkaya Sk. No:9/5, Melikgazi / Kayseri, Türkiye, MERSİS no. 0187151766100001 ("BubiApps", "we", "us").

The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA", https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). The terms below are additional terms between you and BubiApps; if they conflict with the Standard EULA, the Standard EULA prevails for anything it covers. Apple is not a party to these additional terms. Our Privacy Policy (https://mochipack.app/privacy) explains how we handle personal data.

By using the app you agree to these terms. You must be at least 13 years old to use Mochi Pack; if you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms for you.

1. The service

Mochi Pack helps you plan what to pack: it creates a packing list for your trip (with AI if you agree, or with built-in rules), lets you check items off, share lists with travel companions, set reminders and see weather and currency information. You can start without an account.

2. Plans and payments

All purchases are made through the Apple App Store. Apple is the seller and charges your Apple Account; Apple's Media Services Terms and its payment and refund policies apply to the purchase.

• Free preview: you can create your first trip and see a preview of its list before deciding whether to buy.
• Yearly (auto-renewing subscription): unlocks all trips and features for one year. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for another year at the then-current price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the period. You can manage or cancel the subscription in your Apple Account settings (Settings › your name › Subscriptions); cancellation takes effect at the end of the current period.
• Introductory offers: we may offer a discounted first year. The offer price and duration are shown before you buy; after the offer period the subscription renews at the standard yearly price unless you cancel at least 24 hours before the offer period ends.
• Free trial (if offered): a free trial converts into the paid yearly subscription unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial ends when you buy a subscription.
• Lifetime: a one-time purchase that unlocks all trips and features for as long as we operate the app, with no subscription and no renewal.
• Trip Pass: a one-time purchase that unlocks a single trip (the trip shown when you buy it, or the next trip you create). Once used it cannot be moved to another trip. Because a Trip Pass is a consumable purchase, the App Store cannot restore it on another device; sign in with Apple after buying to keep it with your account.
• Prices are shown in the app in your local currency as provided by the App Store and include applicable taxes where the store requires it. Price changes for subscriptions follow Apple's rules, including notice and, where required, your consent.
• Family Sharing: the Yearly subscription and Lifetime can be shared with your Apple Family Sharing group. Trip Pass cannot be shared. People you invite to a trip do not need to pay (see §3).
• Refunds and withdrawal: refunds are handled by Apple under its policies (https://reportaproblem.apple.com); we cannot issue refunds ourselves. Your statutory rights against the seller, including any right of withdrawal under consumer law, are exercised through Apple. A refunded purchase no longer unlocks what it unlocked, except that a trip already unlocked with a Trip Pass stays unlocked.
• Restore purchases: use Restore in the app with the Apple Account you paid with.

3. Sharing trips

• People you invite to a trip join for free and can see and, depending on the role you choose (editor or viewer), change that trip's list. Invite links expire and can be revoked.
• You are responsible for whom you invite and for the content you add. Do not put other people's sensitive personal data into shared lists.
• If you delete a trip you own, it is also removed for its members (after the 30-day "Recently deleted" period). If you are removed from or leave someone else's trip, you lose access to it.

4. AI features

• AI features are optional and require your consent; you can turn them off in Settings at any time. When AI is on, your trip details are processed by our AI providers (Anthropic for lists and suggestions, Google for trip pictures) as described in the Privacy Policy.
• AI-generated lists, suggestions, assistant answers and pictures are created by a machine. They are for convenience only and can be wrong or incomplete. Always check what you pack against official sources, in particular airline and airport rules for batteries, liquids, sharp objects and dangerous goods, entry, visa and health requirements, and rules for medicines. Notes such as "carry-on only" are reminders, not legal, medical or safety advice.
• Apart from your first generated list, AI does not change your list without your confirmation.
• Fair-use limits apply to AI features (for example a daily number of requests or of trip pictures) to keep the service available and affordable. When a limit is reached the app keeps working with its built-in rules and pictures.
• Trip pictures are illustrations of a type of trip, not images of real places or people.

5. Acceptable use

You agree not to: use the app unlawfully or to harm others; upload content that is illegal, infringing, hateful, harassing or harmful; try to access other people's trips or our systems without permission; reverse-engineer, scrape or overload the service, or bypass App Check, quotas or purchase checks; use the AI features to generate content unrelated to travel and packing, or in breach of our AI providers' usage policies; or resell or commercially exploit the service.

We may suspend or limit access (including to AI features) if you breach these terms, to protect other users or the service, or where the law requires it. Where reasonable we will tell you why and give you a chance to respond.

6. Your content

You keep ownership of the content you create. You give us a limited, non-exclusive licence to store, process and display it only to provide the app to you and to the people you share it with (including sending it to our AI providers when you use AI features). We do not use your content to advertise to you and we do not sell it. You can export or delete your content at any time.

7. Our content

The app, the Mochi mascot, texts, illustrations and the built-in packing catalogue are owned by BubiApps or its licensors and are protected by intellectual property laws. Weather data is provided by Apple Weather; city data includes GeoNames data (CC BY 4.0); country names come from Unicode CLDR; currency rates are reference rates of the European Central Bank. Their attributions are shown in the app.

8. Availability and changes

We work to keep the app available and your data safe (deleted items can be restored for 30 days), but the service may change, be interrupted or contain errors. We may add, change or remove features; we will not remove core features you paid for during a paid period without a fair remedy. If we discontinue the app we will give reasonable advance notice in the app and a way to export your data. Lifetime purchases are valid for as long as we operate the app.

9. Warranty and liability

The app is provided under the Standard EULA's warranty terms. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for intent or gross negligence, for death or personal injury caused by negligence, and your rights as a consumer under the mandatory law of your country of residence.

Subject to the paragraph above and to the extent the law permits: we are not liable for losses that were not reasonably foreseeable, for indirect or consequential losses, or for losses caused by items you packed or did not pack based on a list, suggestion or reminder; and our total liability to you for slight negligence is limited to the amount you paid for the app in the 12 months before the claim.

10. Ending

You can stop using the app and delete your account at any time (Settings › Account › Delete account). Deleting your account does not cancel an App Store subscription; cancel it in your Apple Account settings. We may end these terms if you seriously or repeatedly breach them; paid access you have not used will then be handled under Apple's refund policies and the law.

11. Changes to these terms

We may update these terms, for example when we change features or when the law changes. We will post the new version here and, for material changes, tell you in the app with reasonable advance notice before they take effect. If you do not agree, you can stop using the app and delete your account before the change applies. Changes do not affect purchases already made.

12. Law and disputes

These additional terms are governed by the laws of the Republic of Türkiye. The Standard EULA is governed by the law stated in it. The courts and enforcement offices of Kayseri, Türkiye have jurisdiction over disputes about these terms.

If you are a consumer, this does not take away the protection of the mandatory consumer law of your country of residence or your right to bring a claim in the courts of your country of residence. Consumers in Türkiye may also apply to the consumer arbitration committee (tüketici hakem heyeti) or consumer court of their place of residence or of the place of the transaction, within the monetary limits set each year.
